The Durham Town Clerk’s Office offers notary services:

Free for Durham residents

$5 for non-residents per seal
We can notarize documents including wills and trusts. Important: Town staff cannot serve as witnesses for wills or trusts. This means we cannot testify that a resident was of sound mind, nor can we appear in court or provide a self-proving affidavit for these documents.
Why witnesses matter
Wills generally require at least two witnesses to confirm that the person signing is of sound mind and signing voluntarily. Witnesses help prevent disputes and ensure the will is valid.
Court appearances
If a will is contested, witnesses may be called to testify about the signing. Because town staff cannot act as witnesses, residents must use neutral, non-town witnesses for these documents.
