Please be advised that the United States District Court for the District of New Hampshire has ordered the State of New Hampshire not to enforce the portions of HB 1569 that eliminated the qualified voter affidavit as a means of proving citizenship and the challenged voter affidavit as a procedural safeguard for challenged voters. Effective immediately, the Secretary of State's Office is implementing the Court's order.
As an initial step, voters who lack documentary proof of citizenship, such as a birth certificate or passport, may use the updated qualified voter affidavit form to establish citizenship for voter registration purposes.
Please note that the Court's order does not affect the portions of HB 1569 requiring documentary proof of identity, age, and domicile. Affidavits may not be used to establish identity, age, or domicile. The order also does not affect the requirement that voters present proof of identity when checking in to receive a ballot on Election Day. Voters who do not have acceptable identification on Election Day may not use a challenged voter affidavit to establish identity and obtain a ballot.
